Terms of Service
By ticking the agreement box and completing an online booking with The Balanced Lead, the Client (Owner) agrees to be bound by the following terms and conditions:
1. Statutory Responsibility & Control
Under the Control of Dogs (Scotland) Act 2010, the Client remains the person legally responsible for the dog’s behaviour. The Balanced Lead will maintain "operational control" at all times. By booking, the Client warrants that the dog is not currently subject to a Dog Control Notice (DCN) and has no history of unprovoked aggression.
2. Equipment & Training Tools
To ensure the safety and effective handling of the dog, The Balanced Lead utilises specific professional equipment, including slip leads and long lines. By agreeing to these terms, the Client provides explicit consent for The Balanced Lead to use this equipment during sessions. The Client acknowledges that these tools are used professionally to maintain safety and control in accordance with the dog’s individual needs.
3. Assumption of Risk & Liability
The Client acknowledges that dog walking and training involve inherent risks. While The Balanced Lead maintains professional Public Liability Insurance, the Client agrees to indemnify The Balanced Lead against any costs, claims, or damages caused by the dog to third parties, other animals, or property, unless such damage is a direct result of gross negligence by The Balanced Lead.
4. Livestock & the Scottish Outdoor Access Code
In compliance with the Dogs (Protection of Livestock) (Amendment) (Scotland) Act 2021, The Balanced Lead will keep the dog on a short lead or at heel when near livestock. The Client accepts full liability for any fines or damages resulting from "livestock worrying" caused by the dog. The Balanced Lead will adhere to the Scottish Outdoor Access Code at all times.
5. Off-Lead Exercise Policy
Unless specifically requested otherwise in the "Special Instructions" section of the booking, the Client grants permission for the dog to be exercised off-lead in areas deemed safe and legal by The Balanced Lead. The Client accepts all risks associated with the dog being unclipped. If the Client requires the dog to remain on a lead at all times, this must be stated clearly during the booking process.
6. Veterinary Emergencies & Duty of Care
Under the Animal Health and Welfare (Scotland) Act 2006, The Balanced Lead has a legal duty to prevent animal suffering. In an emergency, The Balanced Lead will attempt to contact the Client. If the Client is unreachable, The Balanced Lead is authorised to seek immediate veterinary care. The Client agrees to be responsible for all resulting veterinary fees.
7. Media Consent & Privacy
The Balanced Lead may take photographs or videos of the dog(s) and, occasionally, the Client (if involved in the session) for use on our website and social media channels. By booking, you consent to this use. If you do not wish for images of yourself or your dog to be used, you must explicitly express this in writing via email or the booking notes. All personal data is processed in accordance with the UK GDPR.
8. Key Holding & Security
The Balanced Lead will store property keys securely and without identifying tags. Keys will only be used for the purpose of service delivery and will be returned upon termination of services.
